1. Acceptance of Terms
By accessing or purchasing from luxmedsupply.com ("Site"), operated by LUXMED Supply ("LUXMED," "we," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use this Site.
2. Eligibility — Licensed Professionals Only
LUXMED Supply sells regulated medical and clinical supplies exclusively to licensed healthcare professionals and authorized medical facilities. By creating an account and placing an order, you represent and warrant that you hold a valid, active license to practice in your state (MD, DO, NP, PA, RN, or equivalent); your practice or facility is authorized to purchase, store, and use the products you order; you will not resell or redistribute products to unlicensed individuals; and all information provided during account registration and verification is accurate and current. We reserve the right to refuse or cancel any order if we cannot verify your credentials.
3. Account Verification
Certain products and pricing tiers are restricted to verified accounts. Verification requires submission of a valid professional license. We reserve the right to revoke account access if verification information is found to be inaccurate, if a license lapses, or if the account is used in violation of these Terms.
4. Products and Pricing
All products are subject to availability. Prices are listed in U.S. dollars and are subject to change without notice. Some products are FDA-cleared medical devices or require a valid professional license to purchase. By ordering such products, you confirm your eligibility to receive them. We reserve the right to correct pricing errors and cancel orders placed at incorrect prices.
5. Orders and Payment
All orders are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, verification failure, or product unavailability. Payment is due at the time of order.
6. Shipping
We ship to addresses within the United States. Orders over $500 qualify for free standard shipping. Shipping times are estimates and not guaranteed. Risk of loss passes to you upon delivery to the carrier.
7. Returns and Refunds
Due to the regulated nature of medical supplies, all sales are final unless a product arrives damaged, defective, or materially different from what was ordered. Claims must be submitted within 7 days of delivery to sales@luxmedsupply.com with photographic evidence. Approved returns will receive a replacement or store credit at our discretion. We do not accept returns of opened sterile products.
8. Regulatory Compliance
You are solely responsible for ensuring that your purchase, storage, and use of products complies with all applicable federal, state, and local laws and licensing requirements. LUXMED does not provide medical, legal, or regulatory advice.
9. Disclaimer of Warranties
This Site and its products are provided "as is" without warranties of any kind, except as required by law.
10. Limitation of Liability
To the maximum extent permitted by law, LUXMED shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the amount paid for the order giving rise to the claim.
11. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York.
12. Changes to Terms
We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance.
